Scope: Representation of general contractor in connection with delay and scope change claims and subcontractor pass-through claims. Defense of false claims allegations. The amounts in dispute were in excess of $5,000,000.
Resolution: Successfully resolved the matter in favor of the general contractor, avoiding any payment obligation.
91ST AVENUE WASTEWATER TREATMENT PLANT
Project: Construction of large municipal wasterwater treatment facility.
Scope: Represented completion contractor in connection with $50,000,000 dispute between original contractor that was terminated and municipal owner.
Resolution: Owner / original contractor dispute settled. Completion contractor not drawn into the dispute and avoided participation in discovery.

Project: Construction of new distribution facility.
Scope: Represented general contractor in connection with insurance claims arising out of the serious injury of a subcontractor and $25,000,000 tort claim asserted by injured employee.

Project: Construction of courthouse.
Scope: Representation of general contractor against federal owner in connection with claim of $2,000,000 for delay, escalation and added scope. Defended general contractor in connection with false claims allegations.

Project: Construction of 545MW combined cycle power plant.
Scope: Represented general contractor on $65,000,000 claim against EPC engineer. Developed delay analysis and claim in addition to acting as as project counsel and litigation counsel.
Resolution: Successfully resolved through claim preparation, litigation and mediation.

Project: Construction of Ritz Carlton Residences development on Maui.
Scope: Represented general contractor in connection with $26,000,000 owner payment default and additional delay and scope claims. Separate dispute with electrical subcontractor involving a $5,500,000 excess completion claim and a $10,500,000 counterclaim for delay and disruption.
Resolution: Successfully resolved all claims in favor of the general contractor.

Scope:Representation of electrical subcontractor in connection with $7,000,000 claim for extra work, delay and productivity loss. Representation of mechanical subcontractor in connection with $28,000,000 claim.
Resolution:Both claims successfully settled through claim preparation, litigation and mediation.
